Document Checklist
Valid for England, Wales, Scotland, and NI, noting that legal rules and court processes vary by nation.
Ownership Evidence
- V5C registration certificate (identifies the registered keeper, not necessarily the legal owner).
Original purchase invoice, receipt and payment records.
Evidence of any transfer of ownership or gift.
Keys, insurance documents and other supporting records. An insurance policy alone does not prove ownership.
Financial Records
- Full itemised breakdown of fees, amounts, dates and daily rates.
Contract clauses relied upon for advertising, storage or cancellation charges.
Evidence showing when charges were disclosed and agreed.
Advertising invoices, storage records, valuations, payment records and receipts.
Communication Logs
- Original emails and attachments, complete WhatsApp exports, SMS messages and call logs.
Signed Sale or Return agreement, electronic signing certificate and audit trail, including timestamps.
Written cancellation requests, replies and delivery or collection records.
Preserving Evidence
Protecting your rights requires meticulous documentation. We provide a structured approach to preserving all communications and financial records related to your vehicle sale.
Communication Logs
Preserve all correspondence, including emails, WhatsApp messages, and call logs. These serve as critical evidence of the agreed-upon terms and the broker's actions.
Advert & Valuation Records
Keep dated copies of vehicle advertisements, advertised prices and price changes, mileage records, condition reports, valuations and comparable listings. Vehicle valuations are estimates and do not conclusively establish market value.
Financial Breakdowns
Request and retain a full, itemised breakdown of all fees and charges. This evidence is essential when disputing a broker's cancellation or retention claims.
Legal Documentation
Keep complete copies of signed Sale or Return agreements, the terms supplied when the agreement was made, electronic signing certificates and audit trails, cancellation notices, formal letters and other relevant correspondence.
