SOR frequently asked questions: 14 days, 90 days, storage fees and ownership
Do all car SOR agreements end after 90 days?
No universal 90-day rule covers all consumer vehicle-brokerage SOR contracts. The signed agreement may state a fixed term, extension or termination process. Check the precise wording.
Do I always have 14 days to cancel?
Not always. The Consumer Contracts Regulations 2013 can provide cancellation rights for qualifying distance or off-premises consumer service contracts. Classification, information provided, performance of the service and any exceptions matter. Missing cancellation information can sometimes extend rights; it is case-specific.
Does the V5C show the legal owner?
No. The registered keeper and legal owner may differ. Save relevant purchase, transfer or gift records and consider who had authority to enter the brokerage contract.
Are storage and advertising fees automatically unlawful?
No. The legal issue is whether a fee was validly agreed, disclosed, fair and correctly calculated. Ask for the terms as they existed at signing and a breakdown of what is being charged.
Can a different company demand the old trader's debt?
A business may say a right to payment was assigned to it. Ask for sufficient written notice and evidence of the claim's basis. Assignment does not make a disputed charge automatically correct or make the original company's director personally liable.
Does a director have to pay company debts?
Ordinarily, a limited company is separate from its directors. Personal liability needs its own legal basis and evidence of conduct; being associated with the company alone is not enough.
